3. Client Responsibilities

To ensure the best possible results, you agree to:

• Provide accurate, complete, and timely information about your business and goals
• Grant us necessary access to your website, analytics, advertising accounts, and other relevant platforms
• Review and approve deliverables within agreed timeframes
• Ensure you have the legal rights to all content, images, and materials provided to us
• Communicate openly and respond to requests in a reasonable timeframe

4. Payments & Fees

• All fees and pricing will be clearly agreed in writing before work begins
• Payment terms may include upfront deposits, monthly retainers, or milestone payments
• Late payments may result in suspension of services until outstanding amounts are settled
• Unless otherwise agreed in writing, all fees are non-refundable
• Value Added Tax (VAT) will be charged where applicable

5. No Guaranteed Results

While we strive to deliver excellent results through proven strategies and best practices, we cannot guarantee specific outcomes such as search engine rankings, amount of traffic, leads, or revenue. Digital marketing results depend on many external factors including competition, algorithm changes, market conditions, and your own ongoing efforts. We will always work transparently and proactively to maximise your results.

6. Intellectual Property

All work created by SplashSol remains our intellectual property until full payment has been received. Upon full and final payment, ownership of the final deliverables (such as website files and approved designs) will be transferred to you. We reserve the right to showcase completed projects in our portfolio and marketing materials unless a separate confidentiality agreement is in place.

7. Confidentiality

We treat all client information with the highest level of confidentiality. Any sensitive business data, strategies, or materials shared with us will not be disclosed to third parties without your explicit written consent.

8. Third-Party Services

We may use or recommend third-party tools and platforms (such as Google Ads, hosting providers, or analytics software). We are not responsible for any changes, downtime, policy updates, or restrictions imposed by these third-party services. You are responsible for complying with their respective terms of service.

9. Limitation of Liability

To the fullest extent permitted by law, SplashSol shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, revenue, data, or business opportunities arising from the use of our services. Our total liability shall not exceed the total amount paid by you for the services in the preceding 12 months.

10. Termination

Either party may terminate the agreement with written notice. Upon termination, you will be billed for all work completed up to the termination date, and any outstanding payments will remain due. Access to ongoing services such as SEO retainers or advertising management will cease upon termination.

11. Changes to These Terms

We reserve the right to update or modify these Terms & Conditions at any time. The most current version will always be posted on this page. Continued use of our services after any changes constitutes your acceptance of the updated terms.
